November 8th has come and gone with what is now looked at as a huge victory in the cannabis industry.
8 of the 9 states with a 2016 ballot measure passed their propositions legalizing marijuana in some form.
Recreational:
California, which was thought to be a sure bet, passed Proposition 64 which legalized marijuana for recreational use. Cannabis will be regulated much like alcohol and is only available recreationally to individuals 21 and over. The law also allows carrying up to 1 once of marijuana or 8 grams of concentrate, legal cultivation of up to 6 plants, and legal industrial cultivation of hemp.
Nevada passed Question 2 with a 53.8% support rate making cannabis legal recreationally throughout the state. Possession of up to an ounce is now legal, along with the cultivation of up to 6 plants, as long as you live within 25 miles from a dispensary.
Massachusetts passed their initiative with Question 4, legalizing cannabis recreationally. Question 4 allows for possession of up to an ounce outside of your residence, and cultivation of up to 6 plants.
Maine joined the ranks of recreational legalization with their passing of Question 1. Residents 21 or older are now allowed to legally have in their possession up to 2.5 ounces of cannabis, legally cultivate marijuana and legalization for participating/creating marijuana social clubs.
Medical:
Florida took their first steps towards full legalization with the passing of Amendment 2. Amendment 2 allows a licensed Florida physician to prescribe medical marijuana to patients with debilitating medical conditions. The amendment also allowed medical centers to produce and distribute marijuana under close watch from the DOH (Department of Health).
Arkansas passed Issue 6, which allows possession of up to 2.5 ounces of medical marijuana by all registered patients.
North Dakota passed their Measure 5 with 63.6% support. The measure made medical marijuana accessible to patients suffering from cancer, AIDS/HIV, PTSD, epilepsy and much more. Possession of up to 3 ounces is now legal, as well as cultivation of up to 8 plants for individuals living more than 40 miles from a compassion center.
Montana is the last state to join the legal ranks for cannabis use. They passed I-182, which expands their medical marijuana laws already in place. I-182 removes the blocks previously held against many and now allows patients to access medical marijuana for several debilitating illnesses.
Rejected:
Arizona was the only state with legalization measures on the ballot this 2016 election to not pass. With medical marijuana already legal in the state, Proposition 205 would have allowed recreational use of cannabis to adults 21 and over, as well as allowing possession of up to an ounce of cannabis. The proposition was opposed by 52% of voters.
